Terms of Service (PRHCC)
Effective date: September 24, 2025
These Terms of Service (“Terms”) govern your use of the PRHCC websites, patient portals, mobile apps, and any content or services that link to these Terms (collectively, the “Services”). By using the Services, you agree to these Terms.
Emergency Notice: The Services are not for emergencies. If you are experiencing a medical emergency, call 9-1-1 or go to the nearest emergency department.
1) Who we are
PRHCC is a Puerto Rico–based healthcare system offering in-person and telehealth services. Some Services may be provided by affiliated entities or licensed clinicians.
2) No medical advice; limited use of content
Information on the public website (articles, FAQs, educational content) is for general information only and does not constitute medical advice or create a doctor-patient relationship. Only a licensed clinician can diagnose or treat you. Do not rely on website content for medical decisions.
3) Accounts, eligibility, and your responsibilities
- You may need an account to access certain features (e.g., patient portal, telehealth). Provide accurate information and keep your credentials confidential.
- You are responsible for activity under your account. Notify us promptly of unauthorized access.
- Do not share portal access unless authorized (e.g., legal guardian or valid proxy).
4) Acceptable use
You agree not to: (a) violate any law or regulation; (b) infringe intellectual-property, privacy, or publicity rights; (c) upload malware or attempt to gain unauthorized access; (d) scrape, harvest, or reverse engineer; (e) misrepresent your identity or insurance information; (f) interfere with Service operation.
5) Communications & consent (email, calls, SMS)
By providing contact information, you consent to us contacting you about your care, appointments, and billing via the channels you provide (including SMS or automated calls where permitted). Certain treatment-related healthcare messages may be permitted without prior consent; marketing messages require opt-in and include opt-out options (reply STOP to SMS).
6) Telehealth & remote services
Telehealth availability depends on your location, clinician licensure, and technology requirements. You agree to truthfully provide your physical location at the time of a telehealth visit and to use required hardware/software. Puerto Rico telemedicine programs and rules may apply to PRHCC’s telehealth offerings.
7) Insurance, billing, and payments
Coverage depends on your plan and medical necessity. You are responsible for charges not covered by insurance. Eligibility verifications displayed in the portal are informational; final benefits are determined by your insurer.
8) Privacy
Your use of the Services is subject to our Privacy Policy (website data) and, if you are a patient, our Notice of Privacy Practices (PHI under HIPAA).
9) Intellectual property
All content, trademarks, logos, and software on the Services are owned by PRHCC or its licensors and protected by law. You receive a limited, revocable, non-transferable license to access and use the Services for personal, non-commercial healthcare purposes.
10) User content & feedback
If you submit reviews, comments, or suggestions, you grant PRHCC a non-exclusive, worldwide, royalty-free license to use them to operate, improve, and promote the Services, without obligation to compensate you.
11) Third-party services
The Services may integrate with third-party platforms (e.g., EHR portals, payment processors). Those services are governed by their own terms and privacy policies.
12) Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent permitted by law, PRHCC disclaims all warranties (express or implied), including accuracy, fitness for a particular purpose, and non-infringement. Educational content is not a substitute for professional medical advice.
13) Limitation of liability
To the fullest extent permitted by law, PRHCC and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from or related to your use of the Services. For paid Services, PRHCC’s aggregate liability will not exceed the amount you paid for the Service giving rise to the claim.
14) Indemnification
You agree to indemnify and hold harmless PRHCC and its affiliates from claims arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.
15) Children’s use
The public website is not directed to children under 13. Accounts for minors must be created and managed by a parent/guardian or as permitted by law. We comply with COPPA where applicable.
16) Governing law; venue
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflicts principles. You agree to exclusive jurisdiction and venue in the state and federal courts located in San Juan, Puerto Rico (unless a separate patient arbitration agreement applies).
17) Changes to the Services and these Terms
We may modify or discontinue features at any time. We may update these Terms; updates are effective upon posting. Continued use constitutes acceptance.
